TERMS & CONDITIONS We require that you have a business name and doing business as (1) a franchised motorcycle dealer, (2) a retail store advertising and having an inventory of motorcycle accessories or (3) full-time recreational vehicle repair shop. A repair shop must have a retail display of accessories in order to buy anything other than repair parts. To apply for dealership, please visit us at wpsorders.com and download the dealer application. Return the completed application as instructed on the application. You must have a business phone number (NOT your residence). We prefer to have a photo of your business showing your business sign. If dealership is a new business, we will require a photo for our files. We reserve the right to refuse selling to anyone we feel does not meet our dealer qualifications. We reserve the right to requalify dealer status at any time. Open account terms are subject to approval and will be billed on a Net 10 Prox. Schedule. The billing cycle runs from the 25th to the 24th of each month, payment is due the 10th of the following month. Past due accounts will be charged 1.5% monthly interest. Accounts that are lapsing into 60 days past due may lose account terms or default to a credit card account status. All merchandise purchased fromWestern Power Sports, Inc., remains the property of WPS until the account is paid in full. Payment chargebacks, for any reason, are subject to a $25.00 fee. If a customer does not qualify or choose open account terms, the default purchase method will be credit/debit card or ACH. All items can be checked for availability at the time you place your order. Your order will be printed in the warehouse nearest you immediately after submission. Items cannot be added to existing orders after order has been submitted. Additional items must be placed on a separate order and are subject to freight minimums and the above small order fee if under $30.00. The words “Arctic Cat”, “Bombardier”, “CAN AM”,‘‘Harley Davidson’’, ‘‘Honda’’, ‘‘Husqvarna’’, “Indian”, ‘‘Kawasaki’’, “KTM”, ‘‘Polaris’’, ‘‘Suzuki’’, “Victory”, ‘‘Yamaha’’, etc., are used as reference only. Some part numbers and descriptions used or mentioned are also used as reference only. No items sold by Western Power Sports, Inc., are manufactured by the above-mentioned Original Equipment Manufacturers or with the permission of any O.E.M. WPS pays freight on orders totaling $300 or more for shipments within the lower 48 states, and $500 or more for Alaska, Hawaii, and Puerto Rico. Large or heavy items may incur additional fees. WPS reserves the right to choose method of shipping. Dealer may request a shipping upgrade to a next day or 2 day air service at their expense. All cross-ships will be shipped at the lowest cost method available. Free freight will be not be given on past due accounts. Backorders DO NOT automatically ship. Upon arrival, backorders are available to ship with your next order. You can ship backordered items by logging in to your account on our dealer website. Backordered items will be held for 7 days after arrival, if not released during that time the order will be canceled. Please note the FREIGHT POLICY, backorders do contribute to your free freight amount, but the free freight total must be reached for each individual order. SPECIAL ORDERS CANNOT BE CANCELED OR RETURNED. Return authorization is required. Call us for the RA number, clearly mark the outside of your package with the RA number, include a copy of the invoice, write down the reason for return, and return the package freight prepaid to the warehouse from which it was shipped. Credit cannot be issued for items purchased 30 days or more prior to return, closeout or discontinued items, special ordered items or electrical parts. Returned merchandise must be in original package with any dealer labels and or price tags removed, and in resalable condition. A restocking fee will be charged on all returns except items that are determined to be defective or not as ordered. Return authorization is required. Call WPS for the RA Number, mark it clearly on the outside of the package and return it freight prepaid to the Boise, ID location. Manufacturers require warranty returns be accompanied by written information regarding length of time used, cause of failure, and any other necessary information. Manufacturers give warranties on their own products and will make the determination if it is a valid warranty, they do not allow distributors to make any decision on whether a product will be replaced or repaired. Damages arising from the design or manufacturing of any item are the sole responsibility of the manufacturer. Information and instructions from those vendors may be available on www.wpsorders.com or through WPS Customer Service. Credits for warranty claims that are denied by the manufacturer may be reversed and the parts returned. Must be reported at the time the package is opened - NO EXCEPTIONS. All orders are checked for accuracy after picking and are weighed to 1/10th of an ounce to give us three ways of checking. ALL BOXES AND PACKING MUST BE SAVED and returned to WPS in most cases to receive credit for damages. We will pay for the postage. TRUCK SHIPMENTS: Claims for lost or damaged goods must be made directly to the carrier, as title to merchandise passes to the customer when goods have been consigned to and accepted by a public carrier. We will furnish any information we have to help you establish your claim. Visual damage to shipping carton or shortages must be noted on the freight bill. PARCEL SHIPMENTS: Indicate ‘‘DAMAGED’’ when signing. CARTON AND MERCHANDISE MUST BE KEPT BY DEALER. Contact us at 1 (800) 999-3388 for instructions. Our FULL restocking fee, plus freight both ways, will be charged to your account for refused orders. Some vendors require warranties to be managed directly, in this case contact the manufacturer. Information and instructions from those vendors may be available on www.wpsorders.com or through WPS Customer Service. WPS can drop ship an order to your customer within the continental US. Freight amount will display at time of order submission. If the ship to address is entered incorrectly, you may be assessed an additional ADDRESS CORRECTION FEE. If “signature required” was not selected, WPS is not responsible for denied freight claims. Drop shipments outside the US and its territories are not allowed. Current dealer and list pricing can be found at www.wpsorders.com. All prices are subject to change without notice. We do, however, make every effort to hold our prices for an entire season. In case of a price change, items will be billed at prices in effect on the date the order is shipped. All prices are FOB WPS Distribution Center unless otherwise noted. Orders are normally shipped payable by credit card. Open account status may be applied for by well-rated firms. To establish an open account, request a credit application when placing an order. PLEASE ALLOW UP TO 30 DAYS FOR PROCESSING THE CREDIT APPLICATION. WPS reserves the right to reject any application. Service Charges —All orders totaling less than $30.00 dealer cost are automatically charged a $5.00 small order fee to cover processing costs. Please contact your sales representative for details.
